ALEXANDRIA, Va. — U.S. Circuit Judge Claude Hilton decided hedid not have to hear oral arguments in order to decide if he shoulddismiss the lawsuit brought by the Coalition For Credit UnionCharter Options against NCUA.

The Coalition, which claims to represent credit unions who mightwish to convert to bank charters sometime in the future, hasbrought suit to overturn the NCUA's regulations governing charterchange disclosure and voting procedures. The NCUA in its filing onthe matter has asked the court to dismiss the case on a variety ofgrounds and oral arguments on the point had been scheduled forOctober 19.

A clerk at the Court said a decision on the motion to dismisscould come as early as this afternoon or still be weeks away.
