ALEXANDRIA, Va. — U.S. Circuit Judge Claude Hilton decided he did not have to hear oral arguments in order to decide if he should dismiss the lawsuit brought by the Coalition For Credit Union Charter Options against NCUA.
The Coalition, which claims to represent credit unions who might wish to convert to bank charters sometime in the future, has brought suit to overturn the NCUA's regulations governing charter change disclosure and voting procedures. The NCUA in its filing on the matter has asked the court to dismiss the case on a variety of grounds and oral arguments on the point had been scheduled for October 19.
A clerk at the Court said a decision on the motion to dismiss could come as early as this afternoon or still be weeks away.
