ALEXANDRIA, Va. – Utah District Judge Dale Kimball has scheduled a new set of briefing dates for the American Bankers Association v. NCUA case over the field of membership expansion of Tooele Federal Credit Union and others. Since overturning his magistrate judge's ruling in favor of the bankers' allowing for broad discovery, Kimball has moved the due date for the ABA's brief up to May 3. NCUA and the intervenors, including CUNA, NAFCU, the Utah League of Credit Unions, Tooele, America First Federal Credit Union, and Goldenwest Federal Credit Union, must submit their response brief in by July 2. The plaintiff's final brief is then due July 30. NCUA Trial Attorney John Ianno said he is "99% certain" that following the briefings there will be oral arguments in the case, possibly 30-60 days after the last brief is filed. The timing of a decision in the case "depends on how crowded that docket is at that time," he said. "We'll get a better feel for that then."
