A federal judge has scheduled a key hearing in the lawsuit brought by Todd Harper and Tanya Otsuka, the former board members of the NCUA, who were removed from their positions by President Donald Trump in April.
Judge Amir H. Ali of the U.S. District Court for the District of Columbia issued a minute order on May 27 setting the hearing for June 12 at 3:00 p.m. The hearing will address both the plaintiffs’ motion for a preliminary injunction and summary judgment and the Trump administration’s cross-motion for summary judgment.

Harper and Otsuka are seeking to be reinstated, arguing that their removal violated statutory protections and the independence of the NCUA, an agency Congress established to oversee credit unions free from political influence. The Trump administration has argued that the president has constitutional authority to remove executive officers, including members of independent agencies.
Both parties will have the opportunity to present oral arguments at the hearing.
The case has drawn national attention amid broader debates over the limits of presidential authority and the independence of financial regulators. It also came just days after the U.S. Supreme Court agreed to hear a related case on whether presidents can fire members of independent agencies at will.
The outcome of this case could have significant implications for the structure and autonomy of federal financial regulators, including the future makeup of the NCUA Board.
