WASHINGTON — Accredited Home Lenders has dropped its lawsuit against the Illinois sheriff who only last Wednesday published an op-ed in the Chicago Sun-Times stating that his office would no longer do evictions because banks were not determining who was living in buildings going into foreclosure even though such due diligence is required by state law.

Cook County Sheriff Thomas J. Dart said that his deputies often arrived at a home to carry out a mortgage foreclosure eviction only to find out that the tenant was current on their rent and unaware that the landlord had stopped using the rent to pay the mortgage.

Dart said it wasn't part of the department's job to carry out investigative work on behalf of banks and other lenders.

Accredited filed suit against Dart on Friday.

"Upon further consideration of the facts surrounding this matter, we have decided to withdraw our petition against the county and have suspended our eviction action against our former borrower Shirley McFarland," an attorney for the subprime lender said.
