NEW YORK – Newtek Business Services, Inc. said it anticipates filing its annual Form 10-K for the year ending December 31, 2005, on or before May 3. The small business services provider and one of CUNA's strategic partners, previously announced that, due to the late filing, it had received an April 18 determination letter from the NASDAQ Stock Market that it was subject to delisting due to non-compliance with the timely filing requirements. Newtek said it expects to file shortly and come into full compliance with all applicable NASDAQ and SEC requirements. Newtek also said its “past level of staff support has proven inadequate to ensure timely financial reporting.” The company said it will address the problems that caused the late filing by adding personnel to its accounting, finance and legal staffs. Newtek said it anticipates no material changes in its previously announced results for the year ended December 31, 2005, and no restatement of any prior period financial statements. Newtek (NKBS) has been listed on the NASDAQ since December 2003.
