Thomas Renz, president of the $32 million Commodore Perry FCU,said he expects a decision from the NCUA's Supervisory ReviewCommittee regarding his exam appealby the first week in December.

SRC Chairman Joy Lee confirmed that timeline, saying thecommittee anticipates issuing a decision on the appeal within 30days.

The Oak Harbor, Ohio-headquartered Commodore Perry alleges itsriskier CAMEL score resulted from examiner retaliation after creditunion management complained to NCUA that its examiner harassedemployees.

Renz said the appeal hearing Wednesday at NCUA headquartersaddressed the question of whether NCUA Region III Director HerbYolles erred when he denied the credit union's appeal of its CAMELscore.

The credit union told the SRC it doesn't believe Yollesconspired to purposely deny the appeal but rather, depended upon“incomplete and incorrect” information from Examiner Roger A. Clark.

“We don't have access to all the information (Yolles) had, butour exam report was incorrect,” Renz said.

The Ohio credit union executive called the hearing “veryinteractive” and said the three NCUA employees that sit on the SRC“listened” to what the credit union had to say.

Lee, the SRC chairman, told Credit Union Times onFriday the committee is “giving full, fair and independentconsideration” to the information Commodore Perry officialspresented in their appeal.

“The committee requested additional information from CommodorePerry and will also meet with appropriate NCUA staff. After thatmeeting and a review of the requested documents, the committee willbe able to issue its decision in accordance with its guidelines andanticipates issuing a decision within 30 days,” Lee said.
