As expected, the Trump Administration filed a motion to stay a federal judge ruling late Tuesday that President Donald Trump acted unlawfully when he removed NCUA Board Members Todd Harper and Tanya Otsuka earlier this year.
“This relief constitutes an extraordinary intrusion on the President’s authority,” the motion read. “Accordingly, Defendants appealed the Court’s order ... and Defendants now respectfully move the Court to stay its order pending appeal.”
U.S. District Judge Amir H. Ali ordered the immediate reinstatement of Harper and Otsuka, citing the “text and history of the NCUA statute, along with the structure and function of the NCUA Board, confirm Congress restricted the President’s power to remove Board members.”
The ruling has been appealed to the United States Court of Appeals for the D.C. Circuit.
