WASHINGTON – The cities of Santa Monica and San Francisco caused quite a stir in the banking world four years ago when they attempted to ban ATM fees in the cities. So far it hasn't worked, and the U.S. Supreme Court has dealt them another setback. The Supreme Court struck down a petition by the cities to hear the case. Four years ago big banks successfully argued that national banking laws override local laws. Next the cities tried to ban ATM fees through the Electronic Funds Transfer Act. Again courts ruled that the cities could not preempt federal law.
