The NCUA has finalized a rule designed to modernize credit union records preservation requirements, giving institutions greater flexibility in managing vital records while eliminating guidance the agency said had become unnecessarily burdensome.

The final rule revises Part 749 of NCUA regulations governing records preservation and disaster recovery planning. According to the agency, the changes clarify the purpose of the regulation, update key definitions and remove outdated guidance that many credit unions had come to view as mandatory requirements.

A key component of the rule is the elimination of two long-standing appendices covering record retention and catastrophic act preparedness. NCUA said feedback from credit unions indicated the appendices, while originally intended as recommendations, had effectively become compliance expectations, leading some institutions to retain obsolete records and incur unnecessary administrative costs.

The rule also provides greater flexibility in how credit unions maintain records preservation logs. Rather than prescribing specific formats and content requirements, NCUA will allow credit unions to determine what information is most useful for locating and accessing vital records in the event of a disaster. Electronic logs and automated systems are expressly permitted.

Under the revised regulation, credit unions must continue maintaining a written vital records preservation program and retain records necessary to restore essential member services, including account access, deposits, withdrawals and loan servicing. However, older versions of records generally may be destroyed once current versions are preserved, unless other laws require longer retention.

NCUA said the rule reflects industry feedback and aligns with the agency's deregulation efforts. The agency believes the changes will reduce compliance burden while ensuring credit unions remain prepared to recover operations following a catastrophic event. The rule becomes effective 30 days after publication in the Federal Register.
