The U.S. Court of Appeals for the D.C. Circuit has denied a request from former NCUA Board Members Todd Harper and Tanya Otsuka for an expedited appeal in their fight to regain their seats.
Harper and Otsuka had argued that the Board needs a quorum to carry out its statutory responsibilities, and sought a fast-track schedule to resolve whether the president can remove NCUA Board members at will. Their proposal aimed to accelerate briefing and hold arguments within weeks.
In a filing earlier this month, they urged the court to reject the government’s request for a stay and proceed quickly. The Department of Justice countered Monday that an expedited timeline was unnecessary, pointing to two pending federal cases involving similar removal power questions that could influence the NCUA dispute.
President Trump removed the two Voard members in April. They were reinstated by a district court order last month, but removed again days later after the appeals court granted an emergency administrative stay.
The appeals court’s denial means the case will proceed under a standard schedule, delaying a final decision on the scope of the president’s removal authority. The court has not yet ruled on the government’s emergency stay motion.
