GREEN BAY, Wis. -- The case between the IRS and a Wisconsin credit union has moved closer to going to trial.
The U.S. District Court for the Eastern District of Wisconsin has announced that District Judge William Griesbach will oversee the case between the $947 million Community First Credit Union and the IRS.
The CU sued the IRS over the more than $54,000 that it paid in federal taxes on unrelated business income, income which the IRS has suggested is not tied to its core business as a credit union. On March 13 the U.S. Department of Justice formally answered the complaint, and the court named Judge Griesbach to the case last week.
A letter from the court that announced Griesbach's appointment to the case also announced a scheduling conference call to be held on May 9 that will establish a schedule for filing and hearing motions, completing discovery and naming any expert witnesses.
CUNA General Counsel Eric Richard has estimated that the parties to the suit will have a much better idea of when there might be a final outcome once the May 9 conference is held. He declined to comment on what the government might seek during discovery but noted that discovery was often a part of tax cases.
